Contract case between Yanga na Bernard Morrison is set to begin today at the International Court of Arbitration for Sport (CAS)
The case, numbered CA S2020 / A / 739, will be heard by Judge Patrick Stewart from the United Kingdom and is expected to be heard online
Yanga Sc have confirmed that they submitted the necessary documents required by the Court
"The court ordered us to prepare the affidavit of Engineer Hersi Said and send it to the CAS. The club has done so and tomorrow (today) the case will be heard before Judge Patrick Stewart, a British citizen," Haji Mfikirwa, acting Secretary General was quoted by Mwananchi newspaper
In the primary case, Yanga opposes a decision by the TFF Law and Player Status Committee to revoke the two-year contract that Morrison signed with Yanga after the original six-month contract expired
Morrison denied signing the contract but the Players' Law and Dignity Committee in its ruling acknowledged the existence of the contract but claimed it was flawed
Yanga's lawyer Alex Mgongolwa, who is presiding over the case, explained that the main case was to determine whether Morrison had a contract with Yanga or not. The committee was satisfied that he had signed the contract so it should have ended there
Mgongolwa also noted that even the shortcomings mentioned are not among the factors that could invalidate the contract in accordance with the law
Further, the Comettee instructed Morrison to return the $ 30,000 he had taken from Yanga and at the same time declared him a free agent
Morrison was also seen signing a contract with Simba Sc even before the verdict in the case was handed down and despite the recommendations made by the Ethics committee to take action against the player, nothing has been done
A few months before the scandal, Morrison lodged a complaint against an alleged agent of Simba giving him a $ 5,000 bribe to sign a contract with Simba
Yanga filed a complaint to TFF over the allegations but nothing was done and later, the TFF Committee revoked Morrison contract with Yanga just days after he was seen signing a contract with Simba
Yanga filed a case at (CAS) believing that after losing their right to the local football management authorities, they could get it there in the Sports Arbitration Court
The case is expected to be heard in two days, with a verdict likely to be handed down this week
